Some states like NJ & NY set a minimum number of hours that must be worked in order for the employee to be considered eligible for the employee health . Why is there this law? Who does it protect, the employer, the employee, or the health company? If it is to protect the employer, why not rely on employer policy. Likewise, if it is to protect the company, why can’t the company rely on a contractual minimum hours policy? It seems strange that state law would require such a condition.

    If you are not a full time employee he is not required to provide group health insurance for you and that saves him money. You may want to work full time but he has the right according to law not to pay for your health insurance if you work fewer hours. That is all over the U.S. It is optional for employer to offer health insurance because it has become so expensive.

    Those are IRS laws. It’s designed to keep people from adding relatives or friends to their group health insurance policies and calling them employees, when they don’t actually work, just to get them benefits. See, those benefits that the employer pays for, are TAX DEDUCTIONS on their income – and by adding all these extra people, the employer pays less in income taxes.

    That is one of the parts of Health care that DOES need changing – each state may make it’s own laws. Some states require you to pay for coverage you do not want, such as Alcohol abuse treatment, hair transplants, etc. That is what makes premiums so high. If we were allowed to buy only coverage we want and buy across state lines, we could have far better insurance. Congress does not think this way, however because if takes control away from them.
