My friend fell out of my car is my car insurance going to have to cover the medical bills?
My friend was the passenger and didn’t have the passenger door closed and when we went around a turn he fell out and thought he broke his ribs so he went to the emergency room … Is my car insurance company going to be responsible for picking up the medical bills?

If you live in a No-Fault state, you have PIP coverage. PIP pays for meds regardless of fault. If you have only medical payment coverage, this too will pay for his meds.
However, if you have neither, then he has to prove that you were somehow negligent. From what you have provided us, I do not see that you were negligent. He was the fool that did not close the door properly or wear a seat belt.

yep-ctp insurance. you’ll need an accident report to police. someone will be charged for something over this.

Yes, probably, if he doesn’t have health insurance. Call your auto insurance agent and ask.

if not they are vonerbol to being sued by you or your friend. so it would hurt them more if they didnt cover it in the long run. good luck hope your buddy gets well

They may not pay all of his bills. It can be argued that he wasn’t wearing a seat belt, which means his negligence contributed to his injury. They may say he is 50% responsible because he was negligent.

Why was the car moving with the door open? I don’t know if the insurance company has to pay for stupidity! Don’t you realize YOU are responsible for everyone in your car and everything that happens when you are driving? If the door was open you should not have been driving!!! I don’t know if your insurance will cover you being neglectful, he may have to sue you directly for the medical bills!!! then you will be dropped by your insurance company!!!

Believe it or not, you are responsible for the safety of ALL passengers in your auto!
If a passenger is injured due to a faulty or unlatched door, that’s your fault and your responsibility.
You should be offering to pay for any and all medical!
Not trying to figure a way out of paying!
