My brother is divorced and pays child support and provides for his 2 kids. One of his minor daughters just gave birth to a baby. Will he be required to provide for the baby of his dependent, or will the State of Texas require the baby’s father to "step up"?

Your probably going to have to look up the laws of Texas. I would think that the babys father would have to provide insurance not the babys grandfather. She can also apply for the state aid insurance.

The baby’s father is required to pay the child support. But if the father is a minor, then his father is required to pay the child support.

Well, if his daughter is not legally old enough to care for herself, then she does not have legal guardianship of her new baby. Someone over 18 should have that… whoever has that may be responsible. But because of the situation, there may be something the state might handle.

You may want to look into it legally.

Texas doesn’t require that every child have health insurance. Unless stated in the divorce decree, your brother wont have to provide insurance for the baby. If worried about the baby having health insurance, the baby’s mother could enroll it in the Chip program. Health insurance for 6 months for $50. If your brother can afford it, it would be nice for him to put the baby on his insurance, if he can. If he cant, it’s not his baby and therefore not his responsibilty to provide insurance. Good Luck!

the father will have to "step up" but she will also have to "step up". Most likely the baby will be eligible for state insurance covered by welfare.

No. Health insurance is not required. Of course, if something happens to the baby and it has to go to the doctor or hospital, all the bills will have to be paid out of pocket and this can be more devastating than have to pay a little every month for insurance.

Not at all. It’s not your brothers child, its his daughters. because she is a minor she could probably get Medicaid (free insurance) but it’s up to the father of the baby to take care of his kid, not the grandfathers

many health insurance plans won’t cover a dependant’s child. Not unless your brother legally adopts his grandchild. If his health insurance is willing to cover the baby and it doesn’t increase his rates dramactically he should.

You should call the state insurance department or talk to a lawyer.
