If you haven’t accepted (cashed the check) and you can demonstrate to their satisfaction that the value of your car is $11,000, you should be able to at least get the full $10,000. It’s better than $8400 and easier than suing. If she was only carrying low, mimimum $10,000 liability limit and you did sue her and win, would she even be able to pay the judgement? Doesn’t sound like she has deep pockets.
If you accepted the check, and signed a settlement agreement w/ the insurance carrier, you really can’t do anything except sue her personally.

You sue the lady directly. The insurance company will NEVER pay more than the policy limit. That’s all they are EVER responsible for.
But what you SHOULD do, is put the claim through on your OWN policy, and let your insurance company chase her down for the balance, and your deductible.

In other words, you’re not carrying collision coverage on your own car? Too bad.
The other insurer is absolutely not obligated to pay out anything over their liability limit. You either take what they offer or you can sue the other driver (but that does not assure that you’ll ever collect anything).

Ya, you need to go after the woman directly. If she was only carrying a 1,000 max payout on her policy, that’s all you’d get from her insurer.
