		<description>If you were issued the policy as you say and you were actually a non-smoker and then you began again, then NO - it is not misrepresentation.  If you die, they pay.  Also, most life insurance policies have a two year contestability period (that means there is a two year window for the company to contest the validity of the policy.  if you&#039;re past the two year window even with some misrepresentation, the policy will still pay out. 

If you actually are a smoker and just lie about it, the chances are almost 100% that they will have caught that even before they issue the policy because it will show in the blood test.</description>
